Terms The following charges have been accepted by the customer who places his order with Mamo Transportation, Inc. (MTI) Roadworthy Vehicles The Department of Transportation and Federal Motor Carrier Safety Administration have published basic minimum standards for all vehicles that travel US highways. Vehicles released to MTI for transport must be safe and all systems -including brakes- must be in proper working order. All vehicles must have fully functioning rear lights, marker lights, turn signals, tail lights, mud flaps where appropriate, and roadworthy tires with a minimum of 3/32 tread and solid sidewalls. All repairs in transit are the responsibility of the customer; where prepayment is authorized, costs of repair plus a 10% service charge will be invoiced to the customer. The charges are in addition to the line haul transportation charges. If during the course of transport the vehicle should be subject to a USDOT roadside inspection and citation, resulting fines and/or mandated charges will be the responsibility of the customer. Customer payment is preferred, but if circumstances demand prepayment by MTI, charges plus 10% will be added to line haul charges for the delivery. MTI accepts no responsibility for fines, penalties, impound and/or storage charges, legal or court costs assigned to the vehicle. Payment Terms First shipments and shipments for customers who do not have credit approval are prepaid - and can be paid by credit card, wire transfer, or over night delivery of certified check. Terms for customers with approved credit are net 30 days from date of invoice. Interest on overdue accounts will be charged at a rate of 1.5% per month, compounded. Damage Disclaimer Certain categories of events are not covered by insurance: Acts of God, the public enemy, authority of law, riots or strikes, the act of default of shipper/owner, or the natural vice of the commodity transported. In Addition, MTI accepts no responsibility for damage or claims relating to road hazards: damage caused by road debris including - but not limited to - stone chips, tire damage, salt or sand damage, and glass damage to mirrors, windows or windshields. Mechanical Failure MTI accepts no liability for mechanical failure including but not limited to engine, transmission, clutch, bearings, drive line, U-joints, rear-ends, axles, oil pans, etc. MTI accepts liability ONLY IF the damage was caused by an act or omission of an MTI driver as determined by a neutral industry recognized expert. Break Downs All costs of vehicle breakdowns, towing, parts and/or repairs will be the responsibility of the customer. If circumstances require prepayment of any charges, MTI will invoice costs plus 10% to customers. Down Time/ Driver Waiting Time If the driver is not released from a broken-down vehicle, and stays with the vehicle to assure its safety, MTI will assess a $25 per hour fee for each hour or portion of an hour that the driver is delayed - subject to a maximum of 11 hours per 24 hour period. All additional costs of a break down such as lodging, transportation, meals, expired permits, missed flights or return transportation will be charged to the customer plus a 10% service charge. These charges will be in addition to the line haul transportation charges. International Boundary Crossings and Port Deliveries MTI will invoice an international crossing fee of $250 in addition to all other applicable fees for those shipments which cross US/Canadian boundaries. MTI will invoice an additional $50 for all deliveries to a shipping port. Trip Permits All trip permits, custom permits, over size permits which may be required to complete over-the-road delivery of a vehicle will be charged back to the customer plus a 10% service fee. These charges will be in addition to line haul transportation charges. Safety Equipment All vehicles transported must contain a fully-functioning fire extinguisher, flares or reflective triangles. If the vehicle is fined because this equipment is inoperable or missing, cost of fines will be invoiced to the customer plus a 10% service fee. These charges will be in addition to line haul transportation charges. Attempted Pick Up If delivery service has been ordered, a driver has been dispatched, and the vehicle is not available, ready, or not roadworthy, MTI will charge an attempted pick-up fee of $350. This charge is in lieu of line haul transportation charges. Fuel Levels in Vehicles All trucks must contain sufficient fuel upon pick up to allow the driver to safely travel to the first available/open fueling station selling the required type of fuel used by the vehicle being transported. In the event that the truck runs out of fuel en route to the fueling station, all costs incurred to fuel and restart the vehicle - including road service and/or towing where required - will be invoiced to the customer plus a 10% service charge. This charge is in addition to line haul transportation charges. Diminished Value or Contingent liability/Loss of Use Claims MTI accepts no responsibility for and will honor no claims for either diminished value or contingent liability. Claims will be settled by common law, bill of lading law, and insurance law as these govern Carmack Amendment protection of customer vehicles. Similarly, MTI will not accept responsibility or honor claims for "delay in transit". Shipments are moved on an as-available basis, and only move as expedited shipments if expedited service has been requested and higher expedited rate will be paid. Road and weather conditions, USDOT hours of service regulations, -even road construction and/or national emergencies - may delay highway movement of a vehicle. Delivery times are not guaranteed. Physical Damage Insurance MTI has in force $100,000 in physical damage insurance for customer vehicle while it is in the care, custody and control of MTI. Vehicles valued at higher value may be insured on a per trip basis at an additional charge; the value must be stated on the trip order for the higher level of coverage to apply. High value vehicles released for shipment without this information will be insured to $100,000 only. Dispute resolution In the event that there may occur a disagreement over terms and/or conditions and/or a vehicle delivery (or deliveries), customer agrees that if the problem cannot be resolved satisfactorily between the parties (customer and MTI), that any law suits or legal actions will be filed in the courts of St Joseph County, Indiana.
